Woolrich sues company over Elite inventory, seeks $654,821

WILLIAMSPORT — A decade ago, Woolrich Inc. unveiled its Elite Series of tactical clothing for law enforcement and security personnel.

The line of clothing did not produce the anticipated profits, so in 2013 Woolrich Inc. decided to leave that apparel business and sold the inventory to ATS Tactical Gear of Hopkinsville, Ky.

Now Woolrich is suing ATS and ATS Elite Ltd., based in Belise, saying the company still owes it $654,821 from the sale, and is infringing on Woolrich’s trademark.

A Dec. 13, 2013, agreement gave ATS a limited license to use the Woolrich Elite Services trademark until all inventory was sold or the second anniversary of the contract execution.

Under the agreement, which was twice modified, Woolrich was to be paid in full by Dec. 30, 2016. But Woolrich says the last payment it received was $12,500 on Nov. 4, 2015.

The breach of contract suit in U.S. Middle District Court alleges the defendants continue to infringe on Woolrich’s trademarks, and seeks triple damages and all profits from the use of those trademarks.

Woolrich also is asking for a permanent injunction to prevent continued infringement.

Woolrich, America’s oldest outdoor clothing company, was acquired by its European partner, W.P. Lavori in Corso, last November.

Woolrich International is based in London, but Woolrich Inc. remains headquartered in the Clinton County village that bears its name.
