LOCK HAVEN -- A former Lock Haven University student who was found guilty of sexually assaulting an 18-year-old female at a party in 2019 meets the criteria as a sexually violent predator, according to licensed psychologist William G. Allenbaugh, II.
Allenbaugh, who is a member of the state's sexual assessment board, testified during a hearing on Tuesday in the Clinton County Courthouse for Devon Jarrett Bushor, 23, of Hughesville. Bushor was found guilty in March of charges of sexual and indecent assault.
According to Pennlive, he was acquitted of rape, aggravated indecent and another indecent assault charge.
The charges stemmed from a November 2019 party at the Alpha Chi Rho or "CROW" fraternity house. That organization is not officially recognized by the university, Pennlive reported.
Determination of whether Bushor is a sexually violent predator is needed before his sentencing, which may not occur until next year after Judge Michael Salisbury was forced to continue the hearing.
Pennlive reports this was due to Bushor's Williamsport attorney, Michael C. Morrone, not being present during Tuesday's hearing.
One of Morrone's associates, Matthew A. Diemer, was sent in his place. Diemer told Judge Salisbury he learned of Bushor's case less than two hours earlier and he would be filling in and knew nothing about the case, Pennlive reported. Due to this, he was not able to cross-examine Allenbaugh.
He explained Morrone had an 11 a.m. court proceeding in Northumberland County that ran late, according to reports from Pennlive. The judge also learned the defense expert had not completed his report on why Bushor should not be designated a sexually violent predator.
Salisbury "attached" Morrone when the date for resuming the hearing would be known. There will be no further continuances, he said.
Morrone had requested a continuance of Tuesday's proceeding that the judge denied Monday, Pennlive reported.
The following is a summary, compiled by Pennlive, of the testimony during the two-day trial in March:
The victim attended the party with the friend with whom she was visiting on campus.
She was observed visibly intoxicated, vomiting and falling down a flight of stairs before being escorted by Bushor and another student to an isolated part of the house.
Fraternity brothers concerned about her well-being repeatedly gave her water to drink and Bushor remained with her.
When others returned to the room they found the victim nude from the waist down and Bushor standing near her. Witnesses reported seeing bloody scratches across her abdomen and hip.
Bushor later told others he had attempted to have intercourse with her.
The female testified she was extremely drunk, her memory was fragmented and she had never met Bushor before and did not know his name.
What she remembered was her arms being pinned down to her sides and being unable to move, she said.
One of the factors Allenbaugh said he considered in concluding Bushor is a sexually violent predator was he had engaged in similar activity with a female Lock Haven student three months earlier.
In that case, Bushor pleaded no contest to a charge of indecent assault by force and was sentenced in January 2022 to eight months to two years minus a day followed by three years' probation. He was granted parole that September.
He is required to register as a sex offender for 25 years due to that conviction.
Allenbaugh also testified he found Bushor appears to select females who had been drinking, had a mental abnormality and were a risk to repeat.
Bushor, a Lock Haven student from 2018 to 2020, remains jailed because his bail was revoked after he was found guilty.
On July 1, 2022, Lock Haven, Mansfield and Bloomsburg became the Commonwealth University of Pennsylvania.
