JSASD agrees to settle racial harassment suit for $50K
JERSEY SHORE — A $50,000 settlement has been approved in a civil rights suit in which a former Jersey Shore Area School District student complained of racial harassment.
The approval Monday by U.S. Middle District Magistrate Judge William I. Arbuckle resolves the complaint filed in 2022 by the parents of a biracial student who is now 17.
Jenna Swisher and Reginald Gallman attributed the racial harassment and bullying to which their daughter was subjected as the reason she was withdrawn from the district.
The parents claimed the continuous harassment began in 2018 when she was in middle school but the perpetrators were not disciplined.
Examples cited in the complaint included being called by a Black girl’s name and a monkey, Baa Baa Black Sheep sung to her and use of the “N” word. Other Black students were subjected to similar treatment, the document stated.
The girl’s parents claimed she suffered a breakdown on March 17, 2022, that they attributed to “ongoing racial discrimination.”
The suit detailed Swisher’s complaints to the school district and what the parents claim was inaction on them.
Judge Matthew W. Brann last October dismissed the due process claim but allowed the rest of the suit to continue.
Arbuckle, in approving the settlement, agreed with Swisher and Gallman it was in the best interest of their daughter.
He also found the $50,000 was a reasonable resolution to the dispute in which the district does not admit liability.
Attorney and other fees totaling $13,349 will be deducted from the $50,000 with the rest placed in a certificate of deposit to which the girl will have access to when she turns 18.
Four school administrators had been defendants but were removed from the case last June.
The case went from Brann to Arbuckle by consent of the parties.
